本使用條款(以下簡稱「本條款」)係就東聯國際股份有限公司(EASTERN UNION INTERNATIONAL LIMITED,以下簡稱「EUI」)依香港法例第615章《打擊洗錢及恐怖份子資金籌集條例》由香港海關金錢服務監理科批准的經營金錢服務的牌照提供在港人士匯款及相關服務,暨手機應用程式「 EUI Money APP」(包含EUI日後隨時推出之各項APP)相關服務(以下簡稱「本服務」)之使用約定,使用本服務的用戶(以下簡稱「用戶」)同意使用約定內容如下:
These Terms of Use ("Terms") govern the use of the services provided by Eastern Union International Limited ("EUI"), a company licensed to operate money services under Chapter 615 of the Laws of Hong Kong and regulated by the Money Service Supervision Bureau of Hong Kong Customs and Excise Department, offering remittance and related services to individuals in Hong Kong, through the mobile application "EUI Money APP" (including any future apps introduced by EUI) ("the Service"). By using the Service, users ("Users") agree to the following terms and conditions:
Acknowledgment and Acceptance of Terms
1.1 Users should carefully read the contents of these Terms before using the Service. Any objections should be raised to EUI before use. By using the Service, Users indicate that they have read, understood, and agreed to all the contents of these Terms.
1.2. EUI may revise or amend the contents of these Terms at any time. The revised Terms shall take effect 30 days after being published in the EUI Money APP. However, if a User uses the Service within 30 days of the announcement of the amendment to these Terms without objection, the amended Terms shall take effect immediately. If a User disagrees with the amended Terms, they should raise objections to EUI before using the Service. Continuing to use the Service after the amendment of these Terms shall be deemed as acceptance of the modified or amended terms.
User Registration
2.1 Users must provide accurate and true personal identity information for registration, including but not limited to valid Hong Kong Identity Card, passport, personal photo, and other relevant information. Users should promptly update their information if there are any changes. If a User provides any incorrect or untrue information, EUI may suspend or terminate the User's account and refuse the User access to the Service, and the User shall be solely responsible.
2.2 Each User is limited to one account, and Users may not transfer, lend, or allow third parties to inherit their rights to use the Service.
2.3 Each user is limited to registering one account, and users are prohibited from transferring, lending, or allowing third-party inheritance of their usage rights to the service.
About the Service:
3.1 The service allows users to request EUI, through a mobile application, to provide remittance and related services for Hong Kong residents in accordance with Chapter 615 of the Hong Kong Anti-Money Laundering and Counter-Terrorist Financing (Financial Institutions) Ordinance. EUI is obligated to provide the service with due diligence and good faith to ensure that users enjoy the benefits of the service. EUI must also ensure that the terms of service are not less favorable than advertised when soliciting business.
3.2. The exchange rate for the service is based on the rate provided by the system at the time of each remittance transaction.
3.3. When using the service, users are required to pay a handling fee for each remittance transaction. The actual fee amount will be determined by the system's automatic verification at the time of the user's transaction, and the transaction will be deemed complete only after the user's confirmation.
3.4. The service has limits on the amount of remittance. The specific upper limit amount should be handled in accordance with the provisions of Chapter 615 of the Hong Kong Anti-Money Laundering and Counter-Terrorist Financing (Financial Institutions) Ordinance (including its subsequent amendments).
Changes, Termination, and Compensation Responsibility for the Service:
4.1. Depending on the actual operating situation, EUI may, when necessary and without the user's consent or prior notice, change all or part of the content of the service and terminate the provision of the service. If the service is not completed due to the negligence of EUI, EUI's employees, or agents in handling matters related to the service, and this causes damage to the user, if EUI has received the remittance amount and handling fee for the transaction, EUI shall refund the user the remittance amount and handling fee received for the transaction, and shall also pay an additional amount equal to the handling fee for the transaction (excluding the remittance amount) to the user as compensation, unless otherwise required by law.
4.2. Except as provided in the preceding paragraph, EUI shall not be liable for any loss incurred by the user due to service delays or inability to transact caused by temporary transaction suspensions.
4.3 If a user violates the laws of the Hong Kong Special Administrative Region, the laws of other countries or regions involved in the service, or the provisions of the service terms, resulting in any loss to EUI, the user shall be liable for damages to EUI.
Intellectual Property Rights
5.1 The features, services, and works on the EUI Money APP mobile application, including but not limited to text, image files, audiovisual content, are owned by EUI and are protected by copyright, patent rights, trademark rights, trade secrets, other intellectual property rights, ownership, or other rights.
5.2 Users agree and acknowledge that the use of any content related to this service or contained in this service by the user, with the consent of EUI and in accordance with these terms, does not constitute ownership, other rights, or interests in such intellectual property rights.
User Commitments
6.1 Users undertake to comply with the laws of the Hong Kong Special Administrative Region and other countries or regions involved in this service, and guarantee not to use this service for activities that infringe upon the rights of others or are illegal, including but not limited to: money laundering, terrorist financing, fraud, or data theft.
6.2 EUI provides this service and has the right to review users' remittance applications in accordance with the Anti-Money Laundering and Counter-Terrorist Financing Ordinance of the Hong Kong Special Administrative Region, other laws of the Hong Kong Special Administrative Region, and relevant regulations of other countries or regions. When suspicious remittance applications are detected, EUI will refuse to execute the remittance application and take relevant measures in accordance with the laws of the Hong Kong Special Administrative Region and other countries or regions.
6.3 Users shall ensure that the remittance data and personal information provided to EUI are correct and complete. In case of any violation, users shall bear the related losses and be liable for breach of contract to EUI.
6.4 EUI may rely on the electronic transaction data automatically recorded by the EUI computer system for all remittance services provided. If users find any errors in the transaction data, they shall immediately notify EUI.
Disclaimer
7.1 In the following circumstances, EUI may suspend or refuse users' use of all or part of this service without prior notice. However, EUI shall adopt the minimum time and method that affects users, and except for force majeure factors, shall announce it in advance on the system of the mobile application. Users shall not claim any compensation or damages for this:
7.1.1 Users unilaterally cancel completed remittance transactions.
7.1.2 Users provide incorrect identity authentication information.
7.1.3 Resetting, replacing, maintaining, updating, or repairing the software or hardware devices of this service.
7.1.4 Based on EUI's judgment, users or recipients are on the money laundering blacklist or suspected of being involved in the money laundering blacklist, violating the Anti-Money Laundering and Counter-Terrorist Financing Ordinance, and relevant financial regulations of the Hong Kong Special Administrative Region.
7.1.5 The service is suspended, interrupted, or cannot operate normally due to the actions of third parties or other acts not attributable to EUI.
7.1.6 Other users violate the laws of the Hong Kong Special Administrative Region or other countries or regions, or the provisions of these terms, or there is a risk of violation.
7.2 EUI shall not be liable for any loss of customer interests caused by delays in providing or inability to use this service due to natural disasters, wars, terrorist activities, or other reasons not attributable to EUI, or due to orders or measures by competent authorities, public prosecutors, or courts, etc.
7.3 EUI shall not be liable for any loss incurred by users due to the theft of login data or tampering with login data by users through public networks, dedicated networks, other internet communication networks, or other communication networks.
8. Other services or content provided by businesses cooperating with EUI may be included within this service. The responsibility for such services or content lies with the providers of said services or content.
9.Privacy Policy
9.1 Users agree that for the provision and settlement operations of this service, EUI may collect, process, and utilize the personal data of users and recipients, and within the relevant scope necessary for the service, provide such personal data to EUI's parent company, its affiliates, and relevant third parties. Regarding the collection, processing, utilization, and international transfer of user personal data, as well as user rights, please refer to the provisions of Article 9.4. Users agree that EUI has fulfilled its notification obligations in accordance with the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong). If the customer intends to terminate the aforementioned consent, they should also cease using this service and inform EUI in writing to stop collecting, processing, and utilizing the user's personal data.
9.2 Users agree that if EUI and its business partners are required to provide user personal data to the government of the Hong Kong Special Administrative Region and overseas regulatory or law enforcement agencies for authorization or legal requirements, they may do so. Users also agree that EUI may provide the user's personal data to EUI and its business partners, and EUI may use this data to contact the user regarding other products or services related to EUI and its business partners.
9.3 Personal data collected from users by EUI for the provision of this service will be properly preserved in accordance with the requirements of EUI's personal data protection policy, and processed and utilized in accordance with relevant laws such as the Personal Data (Privacy) Ordinance.
9.4 In accordance with the provisions of the Personal Data (Privacy) Ordinance, EUI hereby informs users of the following matters related to the collection, utilization, and processing of user personal data:
9.4.1 Specific purposes of collection: Providing this service (including but not limited to remittance services for Hong Kong residents), handling related business, and other businesses operated by EUI with the permission of the regulatory authorities.
9.4.2 Types of personal data collected: (a) Information provided during user registration: Including the user's name, telephone number, date of birth, Hong Kong identity card number, issuance date, passport number, passport issuance date, passport expiration date, etc. (b) Information required for users to use this service: Information such as the user's and/or recipient's name, telephone number, valid identification number, bank name, bank account number, remittance amount, etc. (c) Information required for verifying and identifying user identity: Including the user's name, telephone number, date of birth, identification number, issuance date, expiration date, etc. (d) Other information collected by EUI for the provision of this service: Including the user's login and system usage time, location, mobile phone model, etc.
9.4.3 Period, region, object, and method of personal data utilization: (a) Period: Based on the duration of the specific purpose, and handled in accordance with relevant legal regulations or contractual agreements regarding retention periods. (b) Region: Locations including the Hong Kong Special Administrative Region, where EUI's parent company and its affiliates (including its overseas branches or subsidiaries) are located, locations of correspondent banks or partner institutions, locations of outsourced business agencies of EUI, and locations of business premises of institutions with business dealings with EUI. (c) Object: EUI, EUI's parent company and its affiliates (including its branches or subsidiaries), correspondent banks, outsourced business agencies, recipients of personal data for cross-border transmission not restricted by regulatory authorities, other institutions with business dealings with EUI, and investigative or financial regulatory authorities authorized by law. (d) Method: Utilization methods including automated machines or other non-automated methods.
9.4.4 Pursuant to the Personal Data (Privacy) Ordinance, users may exercise the following rights regarding EUI's retention of user personal data: (a) Requesting EUI to inquire, access, or request copies, for which EUI may charge necessary costs in accordance with the law. (b) Requesting EUI to supplement or correct, for which the user should provide appropriate explanations in accordance with the law. (c) Requesting EUI to cease collection, processing, or utilization, and requesting deletion, but EUI may not comply with the user's request if necessary for business execution and permitted by relevant laws.
9.4.5 Impact of not providing personal data: If users refuse to provide relevant personal data, EUI will be unable to conduct necessary review and processing operations, resulting in the inability to provide relevant services to users.
10. Governing Law and Jurisdiction
10.1. These terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region and interpreted in accordance with them.
10.2. If users have any questions, complaints, or disputes regarding the services provided by EUI, or need to consult, inquire, or update user or recipient information, they may contact EUI customer service personnel via EUI's online customer service, email, or the dedicated hotline provided on the EUI Money APP.
10.3. In the event of any disputes arising from the use of this service, users may apply for mediation or initiate legal proceedings in the courts of the Hong Kong Special Administrative Region. Users agree that the courts of the Hong Kong Special Administrative Region shall have jurisdiction over any disputes arising from the use of this service or related to this service between the user and EUI.
